Overview

This website is operated by Lunarié. Throughout the Site, the terms “Lunarié,” “we,” “us,” and “our” refer to Lunarié.

These Terms of Service (“Terms”) govern your access to and use of gemsbylunarie.com (the “Site”), including your purchase of products from Lunarié.

By accessing the Site, placing an order, or otherwise using our services, you agree to these Terms and to the policies referenced in them. If you do not agree, you should not use the Site or place an order.

Eligibility and Guest Checkout

You must have the legal capacity to enter into a binding agreement where you live. If you do not, you may use the Site only with the involvement and permission of a parent or legal guardian.

Lunarié does not impose a product-specific age restriction for its initial product offering.

A customer account is not required to make a purchase. Guest checkout is available.

Products

Lunarié makes reasonable efforts to describe and display its products accurately.

The colors and appearance of a product may vary slightly depending on the screen, device, display settings, or lighting used to view it. This does not limit the rights described in our Return & Refund Policy. If an item materially differs from the actual item or description presented at the time of purchase, it may still be treated as an issue with the product.

Natural gemstones may naturally vary in color, inclusions, texture, pattern, and other characteristics. These inherent natural characteristics contribute to the individuality of each gemstone and are not, by themselves, considered defects.

Prices and Availability

Prices, products, styles, and availability may change prospectively.

A later price change will not retroactively alter the price of an order that Lunarié has already accepted.

Product availability may change, and placing an item in a shopping cart does not by itself reserve that item or confirm an order.

Orders

When placing an order, you agree to provide current, complete, and accurate information, including your contact, payment, billing, and shipping information.

Submitting an order does not guarantee that the order will be accepted or fulfilled. Lunarié may refuse or cancel an order for reasons including:

• Suspected fraud or unauthorized activity;

• Product unavailability;

• An obvious pricing or product-information error;

• Inability to fulfill or deliver the order; or

• Violation of these Terms or another store policy.

If Lunarié cancels an order after payment has been collected, the applicable amount paid for the canceled order or item will be refunded.

Payment

Payments are processed through PayPal. Your use of PayPal may also be subject to PayPal’s applicable terms and privacy practices.

You confirm that you are authorized to use the payment method submitted with your order.

Shipping and Delivery

Products are shipped subject to our Shipping Policy, which explains shipping regions, rates, processing times, estimated transit times, address responsibilities, and the handling of certain delivery issues.

Processing and delivery dates are estimates and are not guaranteed arrival dates.

Customers in Alaska, Hawaii, Puerto Rico, other U.S. territories, or using an APO/FPO address must contact Lunarié before placing an order so that shipping availability and cost can be confirmed.

The $6.99 standard shipping rate and the free-shipping offer for orders of $65 or more apply only to the contiguous United States.

Returns, Refunds, Exchanges, and Store Credit

Returns, refunds, exchanges, and store credit are governed by our Return & Refund Policy.

Eligible return requests must be made within 14 calendar days of delivery. Customers must contact Lunarié and receive return authorization and instructions before sending an item back.

Customized and personalized items are final sale except when damaged, defective, or incorrect.

These Terms do not replace or limit any rights expressly provided in the Return & Refund Policy or any rights that cannot lawfully be waived.

Email Marketing

You may have the option to subscribe to marketing emails from Lunarié. Marketing emails will be sent based on your selection or consent, as applicable.

You may unsubscribe at any time by using the unsubscribe link included in a marketing email or by contacting us.

Lunarié does not plan to offer SMS marketing during its initial launch.

Acceptable Use

You may not use the Site or its content:

• For an unlawful or fraudulent purpose;

• To violate the rights of another person;

• To transmit malicious code or interfere with the security or operation of the Site;

• To attempt unauthorized access to the Site, related systems, or information;

• To misrepresent your identity or payment authority; or

• In a way that violates these Terms or another store policy.

Intellectual Property

The Site and its content—including branding, text, product descriptions, photographs, graphics, logos, and design elements—are owned by or licensed to Lunarié and are protected by applicable intellectual-property laws.

You may access and use the Site for personal, non-commercial shopping purposes. You may not copy, reproduce, distribute, modify, publish, sell, or commercially exploit Site content without permission from Lunarié or the applicable rights holder.

Third-Party Services and Links

The Site is hosted by Shopify, and payments are processed through PayPal. Your interaction with those services may also be governed by their respective terms and privacy policies.

The Site may contain links to third-party websites or services. Lunarié does not control those third-party services, and their content, availability, and practices are governed by their own terms and policies.

Privacy

Our collection, use, and disclosure of personal information are described in our Privacy Policy.

Shopify and PayPal also process certain personal information under their own privacy policies in connection with hosting the store and processing payments.

Service Availability and Warranties

Lunarié makes reasonable efforts to keep the Site and its information available and accurate. However, interruptions, technical issues, or inadvertent errors may occur.

To the extent permitted by applicable law, the Site and its content are provided on an “as available” basis. This statement does not exclude, restrict, or waive any warranty, remedy, consumer protection, or other right that cannot lawfully be excluded or limited.

Any rights or remedies relating to damaged, defective, incorrect, or materially misdescribed items remain subject to our Return & Refund Policy and applicable law.

Responsibility

Each party remains responsible for its conduct and obligations to the extent required by applicable law.

Nothing in these Terms excludes or limits responsibility where doing so would be prohibited by applicable law. These Terms do not establish a specific monetary limitation of liability and do not waive non-waivable consumer rights.

Changes to These Terms

Lunarié may update these Terms prospectively to reflect changes to the Site, our practices, or applicable requirements. Updates will be posted on this page with a revised “Last updated” date.

Changes to these Terms will not retroactively alter the price of an order that Lunarié has already accepted.

Severability

If any provision of these Terms is determined to be unlawful or unenforceable, that provision will be enforced to the extent permitted by applicable law or, where necessary, treated as severed. The remaining provisions will continue in effect.

Entire Agreement

These Terms, together with the policies referenced in them, form the agreement between you and Lunarié concerning your use of the Site and purchases made through it.
